SEXUAL ASSAULTS
A person is guilty of sexual assault if they unlawfully and indecently assault another person; or procure another person, without their consent, to commit an act of gross indecency; or witness an act of gross indecency by the person or any other person.
Definition of Assault
A person who strikes, touches, moves, or otherwise applies force of any kind to another person without consent, is said to assault another.
Definition of consent
Consent is given when a person with cognitive capacity can give consent freely and voluntarily. A person does not give consent where there has been:
- force; or
- threat or intimidation; or
- fear of bodily harm; or
- exercise of authority; or
- false and fraudulent representations about the nature or purpose of the act; or
- mistaken belief induced by the accused person that the accused person was the person’s sexual partner
Penalty
If you have been charged with sexual assault, the maximum penalty is 10 years imprisonment.
If the indecent assault or act of gross indecency includes bringing into contact any part of the genitalia or the anus of a person with any part of the mouth of a person, the person will be liable for a maximum penalty of 14 years imprisonment.
If the person is or pretends to be armed with a dangerous or offensive weapon, or is in company with any other person; or penetrates the offender’s vagina, vulva or anus to any extent with a thing or a part of the person’s body that is not a penis, the person will be liable for a maximum penalty of life imprisonment.
RAPE
You can be charged with rape, if you:
- have carnal knowledge (anal intercourse) with or of the other person without the other person’s consent; or
- penetrate the vulva, vagina or anus of the other person to any extent with a thing or a part of the person’s body that is not a penis without the other person’s consent; or
- penetrate the mouth of the other person to any extent with the person’s penis without the other person’s consent.
Penalty
If you have been charged with rape, the maximum penalty is life imprisonment.
If you have been charged with attempt to commit rape, the maximum sentence is 14 years imprisonment.
If you have been charged with assault with intent to commit rape, the maximum sentence is 14 years imprisonment.
